Two Types of Foreclosure States

Judicial Foreclosure (24 States)
The lender must file a lawsuit in court to foreclose. You receive a summons and complaint — and you have a limited window (typically 20-30 days) to file your Answer. The court process gives you more time and more opportunities to challenge the foreclosure.
Non-Judicial Foreclosure (26 States)
The lender can foreclose without going to court — using a power of sale clause in your deed of trust. These foreclosures move FASTER. But you can still fight: file your own lawsuit in civil court to force the bank to respond and defend their actions.
