An Occupancy Affidavit is a sworn statement by the homeowner (or someone with personal knowledge) confirming the occupancy status of the mortgaged property: owner-occupied primary residence, tenant-occupied (investment property), second home, or vacant/abandoned. The occupancy status is critical because it determines: (1) eligibility for owner-occupied loss mitigation programs (many programs are restricted to owner-occupied properties), (2) the applicable foreclosure procedures (owner-occupied properties often have longer reinstatement periods, additional notice requirements, and different posting/publication rules), (3) applicability of dual tracking protections (under CFPB Regulation X, dual tracking protection applies to 'the borrower's principal residence'), (4) eviction procedures (the Protecting Tenants at Foreclosure Act (PTFA) provides tenant protections), and (5) homeowner exemption protections (homestead exemptions, property tax exemptions). Misrepresentation of occupancy status may constitute mortgage fraud.

Who Prepares It
