Program Overview

The Flex Modification is the standard loan modification program for conventional mortgages owned or guaranteed by Fannie Mae or Freddie Mac. Created by FHFA direction to replace the prior HAMP-era GSE modifications, the Flex Modification is designed to reduce a homeowner's monthly principal and interest (P&I) payment by at least 20% through a standardized waterfall of modifications. First, arrears and expenses are capitalized (added to the loan balance). Second, the loan term is extended to 480 months (40 years). Third, the interest rate is reduced (to market rate with a floor of 2%). Fourth, if additional payment reduction is needed, a portion of the principal is deferred as a non-interest-bearing forbearance until the loan is paid off or the property is sold. The Flex Modification is available for both primary residences and investment properties.

  • Must be 60+ days delinquent OR at imminent risk of default (hardship that will cause delinquency within 90 days)
  • Property can be primary residence, second home, or investment property — different requirements for each

  • Borrower in active bankruptcy may be eligible with court approval or trustee consent

Complete the Uniform Borrower Assistance Form (Form 710) and gather required financial documents: pay stubs, tax returns, bank statements, and hardship letter.

Submit a COMPLETE application to trigger RESPA dual tracking protections (37-day rule). Send by certified mail and retain proof of delivery.

If denied, receive the specific reasons for denial and your appeal rights. Appeal within 14 days.
