SCRA Foreclosure Protections: A Complete Guide for Service Members

The Servicemembers Civil Relief Act (SCRA) is one of the most powerful foreclosure defense tools available to military homeowners — yet many service members don't know their rights. Originally enacted in 1940 and significantly updated in 2003, the SCRA provides active-duty members of the Army, Navy, Air Force, Marine Corps, Coast Guard, and Space Force (as well as activated reservists and National Guard members under federal orders) with critical protections against foreclosure. The SCRA's core foreclosure protection is found in 50 U.S.C. § 3953: lenders cannot foreclose on a mortgage that was originated before your active-duty service began without first obtaining a court order. This applies during your period of military service and for 90 days after discharge. In non-judicial foreclosure states — where lenders typically don't need to go to court — this requirement fundamentally changes the process. Any foreclosure or foreclosure sale conducted without court approval during your protected period may be void, meaning you can challenge it and potentially have it set aside retroactively.
The 6% interest rate cap under SCRA § 3937 is another powerful protection. For any pre-service debt — including mortgages, credit cards, car loans, and student loans — you can request that your lender reduce the interest rate to 6% for the duration of active duty plus one year for mortgage obligations. The lender must forgive any interest above 6%, and your monthly payment must be recalculated at the lower rate. For a $200,000 mortgage at 7.5%, this can mean over $250 in monthly savings. To invoke this right, you must send a written request with a copy of your active-duty orders.
The 12 U.S.C. § 3954 protection provides a 90-day post-service window during which lenders cannot initiate foreclosure. This gives you critical time to transition back to civilian life, find employment, and address any mortgage issues without the immediate threat of losing your home. This protection applies regardless of when your mortgage was originated and runs from the date of your discharge or release from active duty.
If a lender files a foreclosure lawsuit against you while you're on active duty, the court must appoint an attorney to represent you before entering a default judgment (50 U.S.C. § 3931). The lender must also file an affidavit certifying whether you're in military service. If the lender falsely certifies that you are not in military service — or fails to check — you may have an independent claim for damages. Additionally, you can request a minimum 90-day stay of any foreclosure proceeding if your military duties materially affect your ability to appear in court or defend the case.
Major banks have paid hundreds of millions in SCRA violation settlements. JPMorgan Chase paid over $62 million for illegally foreclosing on active-duty service members. Wells Fargo, Bank of America, Citibank, and others have all faced Department of Justice enforcement actions for SCRA violations including wrongful foreclosures, illegal interest charges, and vehicle repossessions.
