How to Answer a Foreclosure Complaint
Step-by-step guide to filing a proper Answer that preserves your defenses and avoids default judgment
Overview
An Answer is the formal response to the plaintiff's foreclosure complaint. It is your opportunity to admit, deny, or claim insufficient knowledge about each allegation in the complaint. Filing an Answer is mandatory in judicial foreclosure states — if you do not file an Answer within the statutory deadline (typically 20-30 days from service), the plaintiff can seek a default judgment against you. A well-drafted Answer does more than just respond to allegations — it raises affirmative defenses (such as lack of standing, dual tracking violations, or improper service) that can form the basis for defeating the foreclosure.
When to Use This Procedure
File within the deadline specified in the summons — typically 20 or 30 days from the date you were served. In some states, filing a Notice of Appearance before the Answer extends the deadline. Count from the date of service, not the date the complaint was filed with the court.
Step-by-Step Guide
Read the complaint carefully
Identify each numbered paragraph in the complaint. Each one is an allegation you must respond to. Pay particular attention to: the plaintiff's claimed ownership of the note and mortgage, the chain of assignments, the alleged default date and amount, and any claimed compliance with pre-foreclosure requirements.
Prepare responses for each paragraph
For each numbered paragraph in the complaint, state one of three responses: (1) Admitted — only if you know the statement is true. (2) Denied — if you dispute it. (3) Denied for lack of sufficient knowledge — if you don't have enough information to admit or deny. Never admit the key allegations (plaintiff's ownership, default amount, compliance with requirements) unless they are indisputably true.
List your affirmative defenses
Affirmative defenses are legal arguments that, if proven, defeat the plaintiff's claim even if the allegations are true. Common foreclosure defenses include: lack of standing (plaintiff can't prove it owns the loan), dual tracking (foreclosure while modification is pending), improper service, failure to comply with pre-foreclosure notice requirements, and statute of limitations.
Add a verification or affidavit if required
Some states require the Answer to be verified (sworn under oath) or accompanied by an affidavit. Check your state's rules. Failure to verify when required can result in the Answer being struck.
Include a certificate of service
A certificate of service states how and when you provided a copy of the Answer to the plaintiff's attorney. Include the date, method of service (mail, hand delivery, e-file), and the attorney's name and address.
File with the clerk and serve on opposing counsel
File the original Answer with the Clerk of Court. Serve a copy on the plaintiff's attorney by mail or hand delivery. Keep a date-stamped copy for your records. If e-filing, the system typically handles service automatically.
Important Deadlines
- •Deadline is typically 20-30 days from date of SERVICE, not from date complaint was filed
- •Weekends and holidays count in most jurisdictions — do not wait until day 29
- •If you file a Notice of Appearance first, your Answer deadline may be extended (check local rules)
- •Late Answers may be accepted if a default judgment has not yet been entered — file immediately regardless
Common Mistakes
- ✕Admitting key allegations: never admit the plaintiff owns your loan, the default amount, or that all conditions precedent were met unless you are certain beyond doubt
- ✕Failing to raise affirmative defenses: defenses not raised in the Answer may be waived
- ✕Using the wrong format: most courts require numbered paragraphs corresponding to the complaint
- ✕Not verifying when required: in some states, an unverified Answer is treated as no Answer
- ✕Missing the deadline: a single day can result in a default judgment
