When you submit a loss mitigation application (loan modification, forbearance, repayment plan, short sale, or deed in lieu) to your mortgage servicer, a detailed regulatory timeline kicks in under CFPB rules. Understanding this timeline is essential, because it determines the servicer's obligations, your protections against dual tracking, and your appeal rights. This article walks through each stage.
The process starts when you submit an application. Within 5 business days, the servicer must acknowledge receipt and tell you whether the application is complete or what's missing. If incomplete, they must specify exactly what's needed. You then have the later of 30 days or the date specified in the initial notice to provide the missing documents. Once a complete application is received, the servicer must evaluate it within 30 days.
If your complete application is received 37 or more days before a scheduled foreclosure sale, the servicer cannot proceed with the sale while the application is pending. This is the critical dual tracking protection — the servicer can't foreclose while simultaneously evaluating whether to help you. If the application is denied, you have 14 days to appeal with additional information. During the appeal, the foreclosure sale cannot proceed. If the appeal is denied, the sale can resume — but all of this has bought you weeks to months of protection.
